Why You Should Be Covering Your Employees' Dependents

If you read the fine print of the Affordable Care Act (or the summary on the IRS’s website), you’ll notice it doesn’t just mention your full-time employees when talking about to whom you’re required to offer minimum essential coverage.

In order for the health insurance you offer to meet minimum value - and therefore ACA compliance - it must also extend to the dependents of your full-time employees. And under the ACA, dependents include children and adopted children, up to the age of 26.

Even if you offer health insurance to all of your full-time employees, if it fails to cover their dependents, you can still incur an ACA penalty. Not covering the dependents of your employees signals that the coverage doesn’t meet minimum essential coverage and value, a.k.a. isn’t in compliance with the ACA.

What is a Health Care Marketplace?

With all this Affordable Care Act talk going around, you’ve probably heard the term “Health Care Marketplace,” or maybe even “ObamaCare Marketplace,” dropped once or twice. But just what is this mythical marketplace?

Is it an actual place where insurance salesmen hawk different insurance packages all wrapped up in paper and string? Sort of! But not exactly.

The Health Insurance Marketplace is your state’s price comparison website for subsidized health insurance. Each year during the annual open enrollment period, you can enroll in a plan, switch plans, or apply for cost assistance.

If you don’t receive insurance from your employer, the Health Insurance Marketplace is where you can go to be sure you’re getting health insurance that meets minimum essential coverage and minimum value. And those are things you want to make sure you have, otherwise, you'll have to pay a pretty hefty fine.

As we mentioned earlier, each state has a different marketplace. And you’ll want to make sure you’re on the right website for your state. If you’re in:
If you live in any other state, you’ll use the official Health Insurance Exchange Marketplace website, www.HealthCare.gov. If you live in one of the US territories (American Samoa, Guam, Northern Mariana Islands, Puerto Rico, or the Virgin Islands), you’re not eligible to use the Marketplace to apply for health insurance and should check with your territory’s government offices to learn about your options.

The Adventures of Ace: Ace's Bar-B-Que

Welcome, welcome!

It’s a hot, sunny August day here in the land of ExpressACAForms, and you’re just in time for the bar-b-que Ace is throwing to celebrate (after taking some time for a little R&R, of course) the first ever ACA deadline!




















“Ace sure does like throwing barbeques,” Doc said between bites. “He even got a new grill just for the occasion!”

“Well, Doc,” Ace replied, “it’s the perfect time! It’s still warm out, we’ve got a few weeks of summer left. Plus football season is right around the corner, so we’ll grill out a lot for tailga-”

“No need to convince me,” Doc interrupted. “Your burgers are doing a good enough job of that!”

“So, Ace,” an ACA filer and honored barbeque guest began. “Are we really done with 2015 ACA filing? I mean, there isn’t anything else we need to do, is there?”




















“Unless you’re still working on any corrections, and as long as your forms have been accepted by the IRS, the 2015 ACA filing is over!” Ace replied amidst cheers.

More on the Affordable Care Act

As often as we’ve talked about the IRS ACA Forms 1095-B and 1095-C, we haven’t gone too in depth on the actual Affordable Care Act itself. So while we can’t go super in depth on the legislature in just one post (there’s a lot - the condensed version is 1000 pages long), we can give you a quick overview of how the Act has affected America’s healthcare laws.

In a sentence, the ACA was written to attempt to reform the healthcare system by providing more Americans with affordable, quality health insurance and by curbing the growth in healthcare spending. Keep in mind, though, that healthcare reform doesn’t begin and end with the Act itself. In most cases, the law gives power to ongoing efforts by Health and Human Services and other government programs to reform health care.

Under the Affordable Care Act:
  • All Americans with health insurance are privy to new benefits, rights, and protections which ensure that they get treatment when they need it.
  • Insurance is more affordable. By reducing premium and out-of-pocket costs for millions of families and small business owners, over 32 million Americans who couldn’t afford health care before now can.
  • Risk is spread equally to end insurance discrimination. This means you can no longer be charged more based on gender, health status, or age.
  • A new competitive health insurance marketplace was set up, giving Americans access to group buying power. This also allows Americans to compare plans and receive cost assistance.
  • The budget and economy are put on a more stable path. By cutting government overspending and reining in waste, fraud, and abuse in the healthcare industry, it’s predicted the deficit will be reduced by more than $100 billion over the next ten years, and more than $1 trillion over the second decade.

Nothing in the ACA forces any American to have healthcare or to drop their current healthcare plan, assuming that plan complies with the ACA.

Ace and the 1095s

You heard correctly, taxpayers: Ace is back from his time at ExpressIRSForms to continue helping the “citizens” of ExpressACAForms understand the new Affordable Care Act forms and the e-filing process.




















Worried over what mayhem Confusion’s minions may have wrought in his absence, Ace immediately begins canvassing the city. Much to his surprise (he was gone for a whole day, after all), things seem to be carrying on peacefully. The taxpayers aren’t pulling their hair out or banging their heads against desks over IRS docum--



















Flying into the office building he heard the cries coming from, Ace finds a taxpayer yelling at his computer, unknowingly under the influence of Confusion. At the sight of Ace, Confusion disappears in a wisp of smoke, leaving only the disgruntled employee and the slight scent of bewilderment. Choosing to focus on the task at hand, Ace addresses the employee instead of chasing after the twisting trail of Confusion.




















Ace listens as the employee tells him that he knows they’re a large company and so he thinks they have to file Form 1095-C for each employee but he doesn’t know what he needs to report. “A good question indeed!” Ace exclaims before he launches into one of his world-famous explanations:




















“Well that’s not so bad. And as the Human Resources guy around here, I already have most all of that information! I don’t know why I got so confused,” the employee admits to Ace.

“Twasn’t your fault, taxpayer,” Ace explains to the employee. “Confusion can make fools of us all! And if you need any more help, don’t yell out your window: simply contact one of my sidekicks at ExpressACAForms. They’ll help you file these forms in a snap!”

And with that, Ace flies off to wherever else it is that he is needed.

ACA Forms: What Your Recipients Should Know

If you’re a frequent flier of our Express tax products blogs, you might experience a little déjà vu when reading this one, because today we’re going to focus on what your employees and recipients should know about the Affordable Care Act information return forms. But bear with us, and we’ll try to spice things up for you as you re-review this information!

When we talk about the new ACA Forms 1094 and 1095, we tend to focus on the employers and the providers of health care coverage. Which makes sense: the responsibility of completing and filing these forms falls on them. But there’s a good chance that, at this point, your employees or recipients have asked you about what they need to know about the new ACA filing requirements.

The more you can do to educate your employees or recipients about Forms 1094 and 1095 and their purposes, the less likely you are to deal with confused and frustrated employees or clients. You may even want to consider sending out a notice or having a meeting to explain these forms and how they’ll affect your recipients.

Quick! Who makes the better detective, Sherlock Holmes or a tax accountant? The tax account: she makes more deductions.

Anyway, your employees should know that the ACA requires all employers with 50 or more full-time employees are required to provide affordable health coverage to their employees. These employers and other providers of minimum essential health care coverage will send out a Form 1095 (either B or C) to recipients to provide information about this coverage each January, around the same time they receive their W-2 or 1099s. This form indicates that they had health care coverage for all 12 months, unless they declined enrollment or an error has been made. Let your recipients know who they should contact if an error has been made on their 1095 form. Make sure that if an error does occur, your recipient’s form is updated along with the copy that is transmitted to the IRS.

Introducing ACE: The World's First E-Filing Superhero!


“Look! Up in the sky! It’s a bird, it’s a plane! No...wait, it’s a guy in an orange cape? Oh and his cape snagged on a tree. Yep, he’s down. You see, that’s why capes just aren’t practical.

Ahh that sounds like Ace, the world’s first e-filing superhero. Ace no longer wears a cape, but he does still fly around, helping wherever he can.

No one’s really sure where Ace came from. He just sort of appeared one day. According to his YouTube channel, he was born in a lab, created by scientists “Frankenstein-style.” It was here that he was exposed to high levels of radiation and C-SPAN videos about the Affordable Care Act, somehow giving him the abilities of flight, super-strength, and infinite knowledge about the ACA.

Ace has vowed never to rest until his arch nemesis, Confusion, is defeated once and for all so that ACA forms may be e-filed in peace and harmony. While she apparently has yet to be defeated, no one other than Ace seems to have ever seen her. He just kind of appears, answers questions people have, and abruptly leaves to continue to “fight the good fight” against her.

Ace doesn’t have a utility belt, but he considers his most important tools for fighting Confusion to be his “super awesome brain” and ExpressACAForms.com. When he’s not dropping in (sometimes quite literally) and answering questions about the ACA forms themselves, he regales the city with tales of the ease and speed of e-filing with ExpressACAForms.

“They’ve made the questions easy to understand and provide help text for every step of the way,” Ace said in his most recent address to the public. “And my sidekicks in Rock Hill, South Carolina - where ExpressACAForms is based - are every bit as helpful and knowledgeable as I am! Maybe even more so, as I’ve equipped the fish guarding their office with psychic Confusion-fighting abilities!” Ironically, his last statement that day did cause a bit of confusion in the crowd, which Ace was then quick to clear up.

So he’s not exactly Superman. Okay, okay, he barely beats out Hindsight Lad as far as superpowers go, but he’s trying his best. Plus he refuses to leave until Confusion is gone forever, so we may have to get used to seeing him around. But, hey, at least he does everything with a smile.

ExpressACA Cares: Veterans Day

We at SPAN Enterprises, parent company of ExpressACAForms, would like to take a break from telling you about the wonders that are the Affordable Care Act forms by dedicating this blog post to Veterans Day and extending our deepest gratitudes to those who have served and who continue to serve.

On June 28, 1919, the Treaty of Versailles was signed that officially ended World War I, the war to end all wars (or so we thought). However, the fighting actually ended seven months earlier when an armistice, or temporary ceasefire, between the Allied nations and Germany went into effect on the eleventh hour of the eleventh day of the eleventh month. A year later, President Wilson proclaimed November 11 as the first commemoration of Armistice Day.

On May 13, 1938, the 11th of November was made into a legal holiday, a day to be dedicated each year to the cause of world peace, known as Armistice Day. Armistice Day was primarily set aside to honor veterans of World War I, but in 1954, after World War II required the greatest mobilization of soldiers, sailors, Marines, and airmen in the nation’s history; after American forces fought aggression in Korea, the Act of 1938 was amended by striking out the word “Armistice” and inserting in its place the word “Veterans.”

Veterans Day continues to be observed on November 11, regardless of what day of the week on which it falls. Not to be confused with Memorial Day, a day to remember those who gave their lives while serving, Veterans Day celebrates the service of all U.S. military veterans. It is a day to say thank you to those who have risked - and still risk - their lives when their country needed them.
